DMCA Copyright Policy
Effective Date: November 29, 2025
CaringMary Inc. Inc. ("CaringMary", "we", "us", or "our") respects the intellectual property rights of others and expects its users to do the same. It is our policy, in appropriate circumstances and at our sole discretion, to disable and/or terminate access to the Platform for users who repeatedly infringe or are repeatedly accused of infringing the copyrights or other intellectual property rights of others.
In accordance with the Digital Millennium Copyright Act of 1998 ("DMCA"), we will respond expeditiously to claims of copyright infringement committed using the www.caringmary.com website, subdomains, mobile applications, and related services (collectively, the "Platform") that are reported to our Designated Copyright Agent identified below.
1. DMCA Takedown Notices
If you are a copyright owner (or an agent thereof) and believe that any content on the Platform infringes your copyrights, you may submit a written notification pursuant to the DMCA by providing our Designated Copyright Agent with the following information:
- A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed;
- Identification of the copyrighted work claimed to have been infringed (or, if multiple copyrighted works on the Platform are covered by a single notification, a representative list of such works);
- Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit us to locate the material (e.g., the specific URL(s));
- Information reasonably sufficient to permit us to contact you, such as an address, telephone number, and an email address;
- A statement that you have a good-faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law;
- A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

To be effective, the notification must be in writing and contain all of the items listed above.
3. Response to Valid DMCA Notices
Upon receipt of a valid DMCA notification, we will:
- Promptly remove or disable access to the allegedly infringing material;
- Notify the content provider, user, or account holder that we have removed or disabled access to the material;
- For repeat infringers, in appropriate circumstances, terminate access to the Platform.
4. Counter-Notification
If you believe that your content that was removed (or to which access was disabled) is not infringing, or that you have authorization from the copyright owner, the copyright owner's agent, or pursuant to the law, to post and use the content, you may send a written counter-notification to our Designated Copyright Agent containing the following information:
- Your physical or electronic signature;
- Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or disabled;
- A statement under penalty of perjury that you have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification;
- Your name, address, telephone number, and email address;
- A statement that you consent to the jurisdiction of the court of competent jurisdiction in the judicial district in which your address is located (or, if your address is outside of Canada, the courts of Toronto, Ontario, Canada), and that you will accept service of process from the person who provided the original infringement notification or an agent of such person.
Upon receipt of a valid counter-notification, we will promptly forward it to the party who submitted the original DMCA notice. If that party does not file an action seeking a court order against you within 14 business days, we may, in our sole discretion, restore the removed material.
5. Misrepresentations
Please note that under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material or activity is infringing (or was removed or disabled by mistake or misidentification) may be subject to liability for damages, including costs and attorneys' fees.
6. Changes to This Policy
We may update this DMCA Policy at any time. Changes will be posted on this page with an updated Effective Date.
